Terms of Service
These Terms of Service (“Terms”) govern your use of BoomEstimate (“BoomEstimate”, “we”, “us”) and its website and services (the “Service”). By creating an account or using the Service, you agree to these Terms.
1. The Service
BoomEstimate is an AI-assisted tool that reads uploaded construction plans and produces preliminary cost estimates, proposals, and scopes of work for NYC commercial fit-outs.
2. Estimates are preliminary
Estimates, proposals, and scopes produced by the Service are preliminary, budgetary, and for planning purposes only. They are not a bid, contract, or guarantee of actual cost, and should not be relied upon as the sole basis for a contractual commitment. Actual costs depend on final drawings, site conditions, market pricing, and other factors. You are responsible for reviewing and verifying every estimate before use.
3. Accounts
- You must provide accurate information and keep your credentials secure.
- One login per subscription — accounts may not be shared between people.
- You are responsible for all activity under your account.
4. Acceptable use
- Only upload plans and documents you have the right to use.
- Do not upload malicious files or attempt to disrupt, reverse-engineer, or abuse the Service.
- Do not use the Service to violate any law or third-party rights.
5. Your content
You retain ownership of the plans, documents, and project data you upload (“Your Content”). You grant us a limited license to host and process Your Content solely to provide the Service to you. You represent that you have the rights to upload Your Content.
6. Payments, plans & refunds
Paid plans (e.g., pay-per-estimate and subscriptions) are billed through Stripe. Fees are stated at checkout. Subscriptions renew until cancelled. Except where required by law, payments are non-refundable; contact us with any billing questions.
7. Intellectual property
The Service, including its software, models, rate data, and branding, is owned by BoomEstimate and its licensors. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service.
8. Third-party services
The Service relies on third-party providers (e.g., hosting, payment, email, and AI processing). Your use may be subject to their terms, and we are not responsible for their services.
9. Disclaimer of warranties
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including accuracy, merchantability, or fitness for a particular purpose. We do not warrant that estimates will be accurate or error-free.
10. Limitation of liability
To the maximum extent permitted by law, BoomEstimate shall not be liable for any indirect, incidental, or consequential damages, or for any loss arising from reliance on an estimate. Our total liability for any claim shall not exceed the amount you paid us for the Service in the twelve months preceding the claim.
11. Indemnification
You agree to indemnify and hold BoomEstimate harmless from claims arising out of Your Content or your use of the Service in violation of these Terms.
12. Termination
You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms or to protect the Service.
13. Governing law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules.
14. Changes
We may update these Terms from time to time. Continued use after changes constitutes acceptance of the updated Terms.
